1. Terms of Use
- The Service: Services provided by Azeer include products, features, and tools to help you create and manage your e-commerce business.
- Updates: Any new features added to the current service are subject to these terms. Azeer reserves the right to update or change the terms by posting updates on its website or app.
- Activation: Subscription is activated upon payment. No refunds or cancellations are allowed after payment, except as specified in the Refund and Cancellation Policy.
- Meta Services: Users must comply with Facebook and WhatsApp Business (Meta) terms. Azeer bears no legal responsibility if Meta changes its policies or cancels a client’s account.
- Azeer Wallet: Clients can charge their WhatsApp wallet in USD. Pricing follows official WhatsApp rates per conversation, which vary by country.
1.2 Definitions
- Azeer Platform: Refers to Ratwa Information Technology Company and/or its authorized providers.
- The Client: Any business owner or merchant subscribing to Azeer services.
- The Consumer: Any individual purchasing products or services from the Client through the Client’s Azeer-based website.
1.3 Eligibility
- The user must not have been previously banned from Azeer services.
- The user must not be a competitor providing a product similar to Azeer’s services.
- The user must have full legal capacity to contract.
1.4 License Scope
Azeer grants the Client a non-exclusive, non-transferable, non-assignable, non-sublicensable, and revocable license to use its services. Prohibitions:
- Renting, reselling, or distributing services to third parties.
- Reverse engineering, modifying, or attempting to access the source code.
1.5 Intellectual Property
- Azeer respects the Client’s IP rights regarding their store content.
- The Azeer platform, logos, and symbols are the exclusive property of Azeer and are protected by IP and trademark laws.
1.6 Indemnification & Compensation
- General Rule: A Client cannot claim a refund and compensation simultaneously. Setup and activation fees are non-refundable.
- Liability: The Client is fully responsible for damages arising from violating these terms or any Saudi Arabian laws.
- Meta Disruptions: No compensation is due if service stops due to Meta (e.g., Facebook account ban).
- Azeer Disruptions: If service stops due to Azeer, the Client is compensated for the downtime period only, calculated after deducting setup/activation fees.
1.7 Legal Liability
- Azeer is not liable for damages resulting from the use (or inability to use) the site, including malware, unless caused by intentional misconduct or gross negligence.
- Quality of third-party services (shipping, payment gateways) is the responsibility of those providers.
1.10 Invoicing
All invoices are due immediately. A maximum grace period of 2 days is allowed, after which service will be suspended.
1.11 Refund and Cancellation Policy
- Cancellation: Users can cancel via support@mottasl.com. Upon cancellation, access is revoked, and outstanding balances become due immediately.
- Refund Eligibility:
- Annual/Semi-Annual: Refund request within 7 days of payment. One month’s subscription, used services, and bank fees (9 SAR) are deducted.
- Quarterly/Monthly: Refund request within 3 days. Similar deductions apply.
- Promotional Offers: National Day offers have a 24-hour refund window only.
Documentation Fees: Non-refundable once the application is submitted to Meta, regardless of approval.
